1. Scope and applicable law
These Terms govern the use of the DS Wood Floors website and online store and the rights and obligations between the Merchant and customers when products or services are purchased at a distance.
These Terms apply together with the mandatory laws of the Republic of North Macedonia, in particular the Consumer Protection Law (Official Gazette of the Republic of North Macedonia Nos. 236/22 and 3/25), the Electronic Commerce Law, the Trade Law and the Personal Data Protection Law. Mandatory statutory rights prevail over any conflicting provision of these Terms.
2. Products and product information
DS Wood Floors offers flooring and related materials, including solid, two-layer, three-layer and multi-layer parquet flooring, laminate flooring, decking, skirting boards, adhesives, varnishes, oils and other products displayed on the website.
Product images and visualisations are illustrative. Natural wood may vary in shade, grain, annual rings, knots and structure. Such natural characteristics are not, by themselves, defects unless the product fails to meet the agreed contractual characteristics.
3. Prices, taxes and additional charges
Prices and the applicable currency are displayed on the website. Before an order is confirmed, the customer is shown the total amount payable, including applicable taxes and any known additional charges such as delivery or optional services.
The Merchant may change prices for future orders. An order already confirmed is subject to the price shown at the time of confirmation, except in the case of an obvious technical or pricing error, in which case the customer will be informed before fulfilment.
4. Ordering and contract formation
The customer selects the products, quantities and available options, enters the required information and reviews the order before confirmation.
By activating a button that clearly confirms the obligation to pay, the customer places the order. An electronic acknowledgement of receipt is sent. The Merchant may contact the customer to confirm availability, quantity, lead time, transport or other information required for proper fulfilment.
5. Payment
Available payment methods are shown during checkout and may include payment card, bank transfer, cash on delivery or another method offered on the website.
Where payment is processed by a bank or authorised payment service provider, DS Wood Floors does not store complete payment-card details unless expressly stated, technically required and legally permitted.
6. Delivery
Delivery is available to the locations and under the conditions shown during checkout. Any delivery charge is disclosed before the final confirmation of the order.
Delivery times depend on stock availability, the type and quantity of goods, destination and transport method. If no specific delivery period has been agreed, delivery will be made within the period required by applicable law.
Customers are advised to inspect the external condition of the shipment on receipt and promptly report visible transport damage to the carrier and the Merchant. This does not limit statutory rights relating to lack of conformity.
7. Right of withdrawal for distance contracts
A consumer has the statutory right to withdraw from a distance contract without giving a reason within 14 days, subject to the Consumer Protection Law. For goods, the period generally begins when the consumer or a third person designated by the consumer takes physical possession of the goods.
To exercise this right, the consumer should send an unequivocal statement within the deadline to contact@dsparketi.com. Goods must be returned without undue delay within the statutory period. Direct return costs are borne by the consumer unless the Merchant agrees to bear them or the law provides otherwise.
The consumer may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
8. Exceptions to the right of withdrawal
The right of withdrawal does not apply in the cases provided by law. This may include goods made to the consumer’s specifications or clearly personalised goods.
Where parquet, skirting boards or other materials are cut, processed, tinted, manufactured or otherwise adapted to an individual customer specification, the customer will be informed before ordering whenever the statutory right of withdrawal does not apply to such goods.
9. Refunds
Where a consumer validly withdraws from a contract, the Merchant will refund amounts due within the time limits and by the method required by law. Where permitted by law, the Merchant may withhold the refund until the returned goods are received or the consumer provides evidence that the goods have been sent back.
10. Conformity, warranties and complaints
The Merchant must supply goods that conform to the contract. Unless a longer period has been agreed, the Merchant is liable for lack of conformity that appears within two years from delivery, subject to the Consumer Protection Law.
Consumer complaints may be submitted electronically to contact@dsparketi.com with a description of the issue and proof of purchase. The Merchant will register and respond to the complaint within the statutory period, including the 15-day response period applicable under North Macedonian consumer law.
Any commercial warranty provided for a specific product is additional to, and does not limit, statutory consumer rights.
11. Installation and other services
Where installation, removal, sanding, varnishing, skirting-board fitting or another service is ordered, the scope, price, timing and special conditions will be specified in the quotation, order, pre-contract information or another agreed document.
The customer must provide reasonable access to the premises and the conditions required for safe and proper performance of the agreed work.
12. User accounts and security
Users are responsible for the accuracy of the information they provide and for keeping account credentials confidential. Suspected unauthorised use should be reported to the Merchant without delay.
13. Intellectual property
Text, photographs, graphics, trademarks, logos and other original website content may be protected by intellectual-property rights. Unauthorised copying, publication or commercial reuse is prohibited except where permitted by law or with the prior consent of the rights holder.
14. Personal data and cookies
Processing of personal data is described in the Privacy Policy, while cookies and similar technologies are covered by the Cookie Policy. Those documents form part of the information governing the use of the website.
15. Disputes and governing law
The Merchant and consumer will first seek to resolve disputes amicably. Consumers retain the right to contact competent authorities, inspection bodies, consumer organisations and courts.
Where North Macedonian law applies, these Terms and the relevant consumer contract are governed by the laws of the Republic of North Macedonia. Nothing in these Terms limits mandatory consumer rights.
16. Changes to these Terms
The Merchant may amend these Terms to reflect legal, technical or business changes. A specific order remains subject to the version in force when the contract was concluded, unless mandatory law requires otherwise.
